The trial in federal court in California is scheduled in March 2014
Samsung Electronics has requested the US Court of Appeals to stand by its decision made in October 2012 which denied Apple's request to ban sales of its Galaxy Nexus smartphone.
Earlier this month, Apple asked the US Court of Appeals to once again review a decision by a three-judge panel which denied its request to ban Galaxy Nexus.
Since the denial, Apple has asked all nine active Federal Circuit judges to reconsider the decision.
Reuters reported that Samsung argued in a recent court filing that Apple did not have enough evidence to prove a "causal nexus" between its patented search capability and iPhone sales to justify a ban on sales of the Galaxy Nexus.
The trial in San Jose, California is scheduled for March 2014.
Last month, US District Court Judge Lucy Koh, denied the Apple's request to ban 26 Samsung products from sale.
Last year, Apple won $1.051bn in a patent suit against Samsung, which was claimed to be one of the biggest patent cases in decades.
Apple and Samsung have been involved in patent wars in at least 10 countries for the last 18 months.
